Maryland law distinguishes between driving under the influence (DUI) and driving while impaired (DWI) based on a person’s blood alcohol content (BAC). DUI is more serious. Any reading above a .06 will lead to an alcohol-related charge.
Charges may be initiated if the police feel that a person is under the influence of prescription medication, a controlled dangerous substance, or both.
The potential penalties of even a first DUI or DWI-related conviction include:
- DUI – up to one year in jail and $1,000 in fines, 12 points on your driver’s license, and a six-month minimum license suspension.
- DWI – up to two months in jail and $500 in fines, eight points on your driver’s license, and a six-month license suspension.
- Underage DUI – Maryland has a zero-tolerance law for minors found driving under the influence, which means a BAC of only .02 percent is enough to be charged with DUI. This could result in a $500 fine and a 45-day driver’s license suspension.
- DUI or DWI with a minor in the vehicle – If transporting a minor at the time of arrest, a person may be sentenced to two years in jail for DUI and up to six months for DWI, and fines may be doubled.
